Ngāpuhi Mandate Toolkit
Mandating is the process where the claimant group choose who has the authority to negotiate with the Crown on their behalf for Treaty settlement negotiations. There are multiple stages in the mandating process.

Tupu Tonu – Ngāpuhi Investment Fund Limited
The Ngāpuhi Investment Fund Limited was launched in 2021. It is trading as Tupu Tonu with the purpose of growing assets across the Ngāpuhi rohe for redress as part of future settlements.

Te Whakaaetanga Deed of Mandate submissions process has closed
On 19 September 2024, we received a draft Deed of Mandate from Te Whakaaetanga Trust. We ran a public submission process on the Deed from 21 September to 27 October 2024 and submissions are being reviewed.
Whangaroa Papa Hapū confirmed as hapū grouping
On 24 September 2024, the Minister for Treaty of Waitangi Negotiations confirmed Whangaroa Papa Hapū as a hapū grouping.
Hapū grouping proposal
In the Ngāpuhi context, mandating begins with a hapū grouping proposal. This is a proposal made to the Crown by a group of hapū who have come together for the purposes of Treaty settlement negotiations. It outlines the intent to seek a mandate.
The hapū grouping proposal is a new step for Ngāpuhi and intends to recognise the importance of hapū autonomy. It was introduced after the Crown withdrew its recognition of the Tuhoronuku Independent Mandate Auhority’s mandate in 2019. Previously, Ngāpuhi were recognised as one large natural grouping for Treaty settlement negotiations.
The hapū grouping approach provides for multiple groupings across Ngāpuhi. It was developed following findings by the Waitangi Tribunal's Ngāpuhi Mandate Inquiry that the Crown should apply its large natural group policy flexibly for Ngāpuhi.
After a hapū grouping proposal is submitted to Te Tari Whakatau, it must be confirmed by the Minister for Treaty of Waitangi Negotiations. The hapū grouping can then develop a mandate strategy.
We are expecting there to be around six to eight hapū groupings throughout Ngāpuhi. Each mandated hapū grouping will participate in negotiations at two levels:
- One collective commercial and financial settlement negotiation, together with any other shared matters.
- Regional specific negotiations with each mandated grouping for cultural and historical redress relating to their local lands and historical experience.

Crown negotiators
Te Tari Whakatau is responsible for co-ordinating and negotiating Treaty settlements.
Chief Crown Negotiator
The Chief Crown Negotiators are appointed by the Minister for Treaty of Waitangi Negotiations to lead negotiations with the support of Te Tari Whakatau and other Crown agencies. The Chief Crown Negotiator for ngā hapū o Ngāpuhi is Mr Brian Dickey.
Mr Brian Dickey
Mr Brian Dickey is one of New Zealand’s most respected litigators. He was previously the Crown Solicitor in Auckland, overseeing the prosecution of serious crime in the region, and personally leading those prosecutions of national or regional significance or interest.
He has 30 years’ experience in major litigation, commercial, civil, and criminal in nature and has a particular speciality in commercial regulatory litigation.
The Minister for Treaty of Waitangi Negotiations has appointed Mr Brian Dickey as Chief Crown Negotiator for Treaty of Waitangi claims for Ngāpuhi and Hauraki claimant groups. He also advises other iwi on commercial and land-related matters.

Te Tari Whakatau is responsible for the implementation of the Takutai Moana legislation. They include the Marine and Coastal Area (Takutai Moana) Act 2011 and Ngā Rohe Moana o Ngā Hapū o Ngāti Porou Act 2019.
